2. Scope and consumer rights
These terms apply to orders placed by consumers through our online store. They do not exclude or limit any mandatory rights you have under applicable consumer law. If a provision conflicts with a mandatory consumer right, that mandatory right takes precedence.
3. Products and product information
We aim to describe products accurately and provide their main characteristics before purchase. Colours can vary slightly because of screen settings. Measurements are approximate unless stated otherwise. Product availability can change, including when inventory information is supplied by a fulfilment partner.
Safety instructions, warnings and intended-use limitations supplied with a product must be followed. Contact us before use if required instructions or product components are missing.
4. Prices and additional costs
Prices are displayed in the currency selected for the applicable market. Prices include VAT where legally required. Any delivery costs and other mandatory charges that we collect will be disclosed before you place the order. Customers will not be bound by optional costs that they did not expressly accept.
5. Placing an order
You can review and correct your order before submitting payment. By using the final payment button, you place an order with an obligation to pay. We will send an electronic confirmation after the order is received.
If we cannot accept or fulfil an order, for example because of an inventory error, an obvious pricing error, suspected fraud or a delivery restriction, we will notify you and refund amounts paid for the affected order.
6. Payment
Available payment methods are shown at checkout. Payment processing is provided by Shopify and the payment providers shown during checkout. You must provide complete and accurate billing and delivery information and be authorised to use the selected payment method.
7. Delivery
Available destinations, delivery methods, costs and estimated delivery periods are disclosed before an order is placed where applicable. We will deliver within the period agreed with you and, unless another period is agreed, no later than 30 days after the order is concluded.
We remain responsible for loss of or damage to goods until they are delivered to you or a person you designated, except where you independently appoint a carrier not offered by us.
International deliveries may involve customs formalities, taxes or duties. Where such charges are not collected at checkout, responsibility will be explained before international ordering is enabled.
8. Cancellation and returns
Eligible consumers have statutory withdrawal rights. Details, deadlines and return-cost information are provided on our Cancel or return an order page and in our refund policy.
For a change-of-mind return or statutory withdrawal, the customer pays the direct return-postage cost. Tommy Murr covers reasonable return costs when an item is defective, damaged in transit, incorrect or materially different from what was ordered.
9. Conformity and defective goods
Products must conform to the agreement and meet reasonable expectations based on their description, intended use and applicable law. Your statutory rights concerning defective or non-conforming goods are not limited by any voluntary commercial guarantee or return period.
10. Complaints and customer service
Contact us at glodinas@icloud.com, through our contact form, or through the storefront chat. Include your order number and a clear description of the issue. We will acknowledge and handle complaints within a reasonable period.
11. Personal data
We process personal data as described in our privacy policy. Customer privacy and cookie choices can be managed through the controls provided on the storefront where available.
12. Intellectual property
Unless otherwise stated, the Tommy Murr name, site design, text, graphics and branded images are owned by or licensed to Glodinas Holding B.V. They may not be copied, republished or commercially exploited without permission, except where applicable law permits.
13. Liability
Nothing in these terms excludes liability that cannot legally be excluded, including liability for death or personal injury caused by negligence, fraud, or mandatory product and consumer obligations. Subject to mandatory law, we are not responsible for losses that were not reasonably foreseeable when the purchase agreement was concluded.
14. Events outside reasonable control
We are not responsible for delay caused by events outside our reasonable control. We will contact you as soon as reasonably possible, take reasonable steps to minimise the effect, and preserve any cancellation or refund rights required by law.
15. Applicable law
These terms are governed by Dutch law. If you live in another country, this choice does not deprive you of mandatory consumer protection available under the law that applies to you. Disputes can be submitted to a court with jurisdiction under applicable law.
16. Changes
The terms applicable to an order are those made available when that order was placed. We may update these terms for future orders to reflect operational or legal changes.
